Donald Training, LLC (the “Company”) and/or http://www.Donaldlegacydefined.com.com (“Website”) and/or the Application, and/or the licensors (collectively, the “Company”), values the privacy of the individual and has created this policy (“Privacy Policy”) to demonstrate its firm commitment to transparency about how the Company treats the information of its users of the Website and/or Applications and/or User Content and/or Services. Because the Company gathers important information from our users, the Company has established this Privacy Policy as a means to communicate the Company’s information gathering and dissemination practices.

The Company reserves the right to change this Privacy Policy in accordance with the terms herein and reflected in the End User License Agreement.

What information do we collect?

We collect information from you when you register for an Account on our Application or fill out a form. We will collect any and all information that you, a Parent, or a Coach Account input or upload. We may also collect your physical location through “geo-tagging,” Account User type, first and last name, home or other physical address, including, but not limited to, order history, date of birth, friends list, User-Generated Content (defined in Section 8 of the Terms), training and programing engagement, completion, performance, and competition data and analytics, street name and name of a city or town, and billing information, such as billing name and address, bank account number, routing number and in some instances a credit card number and/or other identifier that permits the physical or online contacting of a specific individual, depending on your activities while on the Application. Any information generated by the Application may contain inaccuracies and DLD does not warranty or guaranty the completeness or accuracy of this information.

What we use information for

Any of the information we collect from you may be used in one of the following ways: to personalize your experience (your information helps us to better respond to your individual needs); to share with your Coach, Parent, or other Users approved by you, your Coach, and/or your Parent; to improve the Application (we continually strive to improve our offerings based on the information and feedback we receive from you); to improve customer service (your information helps us to more effectively respond to your customer service requests and support needs); to send periodic emails. Please refer to the Terms for a further description of information shared between Athlete, Parent, and Coach Accounts. We also use your information to monitor and assemble analytics pertaining to an individual or group’s use of the Application. The Company may use the information that we collect to setup the Accounts for registered users and may also use the information to send information regarding our company or partners. The email address you provide may be used to send you occasional company news, updates, related product or service information, etc. If at any time you would like to unsubscribe from receiving future emails, please reply to the Company email and request that your email address be removed from the list. We may disclose any information (other than billing information) to outside parties. We may share or otherwise transfer to your personally identifiable information to trusted third parties who assist us in operating our Application, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. The Company may aggregate data together in an anonymous fashion to generate reporting for internal analysis or distribution as it sees fit and may, at its sole discretion and for those Users over 18 years old, choose to offer such reporting for promotional purposes and/or monetary gain. The Company may also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties.

Occasionally, at our discretion, we may include or offer third party products or services on our

Application, including through the implementation of advertisements. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of ourApplication and welcome any feedback about these sites. Furthermore, when Users interact with one another, especially in the context of the buyer/seller relationship, Users’ emails, first and last names and other info may be transferred to other affiliated third party businesses. The Company shall under no circumstances be responsible for what buyer/seller or other affiliated third party businesses do with Users’ information.

NIL and Recruiting

The Application may provide links or referrals to third-party resources related to recruiting, NIL

education, athlete development, or transfer guidance. DLD does not control, endorse, verify, or

guarantee any third-party services, content, representations, or outcomes. DLD does not participate in negotiations, representation, contracting, or transactions arising from third-party resources and assumes no liability for any off-platform interactions.

California Online Privacy Protection Act Compliance

Because we value your privacy we have taken the necessary precautions to be in compliance with theCalifornia Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent. Residents of the State of California, under certain provisions of the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain personally identifiable information as defined under California law during the preceding year for third party direct marketing purposes. You are limited to one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. Childrens Online Privacy Protection Act Compliance

DLD does not knowingly permit individuals under the age of thirteen (13) to create an account or use the Application. The Application is intended for users who are at least thirteen (13) years of age. DLD does not knowingly collect personal information from children under the age of thirteen (13). If we become aware that personal information has been collected from a child under 13 without verified parental consent, we will take reasonable steps to delete such information promptly. If you believe that a child under the age of thirteen (13) has provided personal information to DLD through the Application, please contact us at Support@Donaldlegacydefined.com so that we may investigate and, if appropriate, remove the information from our systems.

Online Privacy Policy Only

This online Privacy Policy Application applies only to information collected through our Application and not to information collected offline.

If we decide to change our Privacy Policy, we will post those changes on this page.

Public Forums 

We may offer chat rooms, message boards, bulletin boards, or similar public forums where you and other users of our Application can communicate. The protections described in this Privacy Policy do not apply when you provide information (including personal information) in connection with your use of these public forums. We may use personally identifiable and non-personal information about you to identify you with a posting in a public forum. Any information you share in a public forum is public information and may be seen or collected by anyone, including third parties that do not adhere to our Privacy Policy. In the unfortunate event that your “personally identifiable information” (as the term or similar terms are defined by any Applicable law requiring notice upon a security breach) is compromised, we may notify you by email (at our sole and absolute discretion) to the last email address you have provided us in the most expedient time reasonable under the circumstances; provided, however, delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system as well as for the legitimate needs of law enforcement if notification would impede a criminal investigation.
